Gkaary India Private Limited is not responsible for any incorrect or inaccurate content posted on the Website or in connection with Services, whether caused by Gkaary India Private Limited, Members, or by any of the equipment or programming associated with or utilized by Gkaary India Private Limited. Under no circumstances will Gkaary India Private Limited or any of its affiliates, advertisers, promoters or distribution partners be responsible for any loss or damage, including personal injury or death, resulting from anyone’s use of the Services, any content posted on the Website or transmitted to Members, or any interactions between Members, whether online or offline. Services are provided “AS-IS” and Gkaary India Private Limited expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Gkaary India Private Limited cannot guarantee and does not promise any specific results from use of Services.
Dispute Resolution:
These Terms of Use shall be governed in all respects by the laws of India and you agree to submit to the exclusive jurisdiction of the courts in New Delhi.
Gkaary India Private Limited’s failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision and does not waive the right to act with respect to subsequent or similar breaches.
In the event of any dispute or difference of opinion between the parties arising out of or in connection with this Agreement or with regard to performance of any obligations by either party, the parties hereto shall use their best efforts to settle such disputes or differences of opinion amicably by mutual negotiation. However, if the same still remains unresolved, then such dispute, difference or question in respect of this Agreement or the subject matter thereof, shall be referred to for the decision of Arbitrators appointed by Dayal legal associates. The Award of the Arbitrators shall be final and binding on the parties and the provisions of the Indian Arbitration and Conciliation Act, 1996 or any statutory modifications or re-enactment thereof shall apply to such Arbitration.
If a court of competent jurisdiction holds any provisions of these Terms of Use to be invalid or unenforceable, the remaining provisions will remain in full force and effect and be construed so as to be enforceable to the maximum extent permissible by law. The section headings contained in these Terms of Use are for reference purposes only and shall not in any way affect the meaning or interpretation of these Terms of Use. While technology helps ensure the speed, dependability, and safety of our service, people matter most to the Gkaary experience. Professionalism & Respect Gkaary maintains a zero-tolerance policy regarding all forms of discrimination, harassment or abuse. Non-discrimination
It is unacceptable to refuse to provide or accept services based on a person’s race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under applicable Indian law. This type of behavior can result in permanent loss of access to the Gkaary platform. No inappropriate behavior
Customers and Service Partners expect each other to act appropriately and respect boundaries. It is disrespectful to make derogatory remarks about a person or group. Furthermore, commenting on appearance, asking overly personal questions and making unwanted physical contact are all considered inappropriate behaviors. Anyone who solicits or engages in sexual conduct while using the Gkaary platform may lose future access to Gkaary. We encourage you to be mindful of other users’ privacy and personal space. Violence of any kind will not be tolerated. Compliance with the law
Illegal substances and – unless explicitly allowed by law – open containers of alcohol are not permitted to be requested for delivery. This is against the law and a serious violation of Gkaary’s policy. Furthermore, Gkaary does not tolerate drug or alcohol use by Couriers while using the Gkaary app. If a Client believes a Courier may be under the influence of drugs or alcohol, please request that the Courier to cancel delivery request immediately and alert Gkaary Support at help https://gkaary.com/ Gkaary prohibits human trafficking of any kind, including the commercial sexual exploitation of children, while using our app. anyone who engages in such activity may lose access to Gkaary.
Disabilities
Gkaary expects compliance with all state, and local laws governing the delivery of package with disabilities. Violation of these laws, constitutes a breach of the parties’ licensing agreement.
Following the rules
We require partners to keep documents up to date to remain active. Service Partner, likewise, must maintain active payment information.
Service partners are responsible for guests traveling with them or anyone they request a ride for. It is your responsibility to ensure everyone adheres to Gkaary’s Community Guidelines. Violations of this Community Guidelines could result in loss of your Gkaary Account. Please report any violations to Gkaary, we want to hear your feedback! Alert us and we’ll take action! Emergencies
If at any time you feel that you are faced with a situation that requires immediate emergency attention, please call the emergency service number in your area. Once all parties are safe and the situation has been handled by the authorities, please then notify Gkaary. We will assist and take appropriate action as needed, including cooperating with law enforcement.
